11. Termination and Cancellation
    11.1 Either Alphac Limited or a User may terminate an Account. If Alphac Limited terminates your Account, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, we reserve the right to terminate without giving reasons.
    11.2 If Alphac Limited terminates an Account, any current or pending purchases on your Account will be canceled and will not be dispatched. 
    11.3 Alphac Limited reserves the right to cancel purchases without stating reasons, for any reason prior to processing payment and dispatch. 
    11.4 If purchases are canceled for any reason prior to dispatch Purchasers will be refunded any monies paid in relation to those purchases. 
    11.5 If a User terminates their Account any non-dispatched purchases will be cancelled and a full refund of any monies paid in relation to those purchases will be paid through the payment method used when the Goods were purchased. 
12. Payment
    12.1 If you do not have a credit account then payment is due prior to dispatch of goods. All other Invoices are due for payment on the date shown on the invoice unless alternative arrangements have been agreed upon between the Purchaser and Alphac Limited.

    13.1 Whilst every effort has been made to ensure that all graphical representations and descriptions of Goods available from Alphac Limited correspond to the actual Goods, AlphacLimited is not responsible for any variations from these descriptions. This does not exclude our liability for mistakes due to negligence on our part and refers only to variations of the correct Goods, not different Goods altogether.     14.2 If the Purchaser sells the Goods on to its own customers in any form, either as purchased from Alphac Limited or forming a component part of a larger Good, and any amount of the purchase price payable to Alphac Limited remains outstanding, the Purchaser must account to Alphac Limited for the proceeds of such a sale. The Purchaser is then required to hold such proceeds on trust for Alphac Limited until payment has been received in full by Alphac Limited. 
15. Delivery
    15.1 Alphac Limited will notify you by way of email when your goods are to be dispatched to you. The message will contain details of estimated delivery times in addition to any reasons for a delay in the delivery of the Goods purchased by you.
    15.2 If Alphac Limited receives no communication from you, within 3 days of delivery, regarding any problems with the Goods, you are deemed to have received the Goods in full working order and with no problems. 
    15.3 Our couriers and Royal Mail/DPD will abide by their standard Terms and Conditions when delivering your consignment. This may include delivering to a neighbor if no one is at your address.

16. Returns Policy
    Alphac Limited aims to always provide high-quality Goods that are fault free and undamaged. On occasion however, goods may need to be returned. Returns are governed by these Terms and Conditions.
    16.1 If the Purchaser receives Goods that do not match those ordered unless accompanied by an explanatory note detailing the changes, stating reasons for the changes, and setting out your options, the Purchaser should contact us within 10 working days to arrange collection and return. Alphac Limited is responsible for paying shipment costs. The Purchaser will be given the option to have the Goods replaced with those ordered (if available) or to be refunded through the payment method used when the Goods were purchased.     16.2 If any Goods purchased have faults when they are delivered, the Purchaser should contact Alphac Limited within 28 working days to arrange collection and return. Alphac Limited is responsible for paying shipment costs. Goods must be returned in their original condition with all packaging and documentation.     16.3 If any Goods develop faults within their warranty period, the Purchaser is entitled to a repair or replacement under the terms of that warranty. 
    16.4 If Goods are damaged in transit and the damage is apparent on delivery, the Purchaser should sign the delivery note to the effect that the goods have been damaged. In any event, such damage should be reported to Alphac Limited within 10 working days and arranged for collection and return. Alphac Limited is responsible for paying shipment costs.     16.5 If the Goods have been dispatched or have reached you, but the Purchaser decides that they are no longer required, the Goods can be returned to Alphac Limited within 10 days of receipt. Goods can only be returned for this reason if their packaging remains unopened and the Goods can be re-sold, as new, without any additional work on the part of Alphac Limited. The Purchaser is responsible for paying shipment costs if Goods are returned for this reason. 
    16.6 If the Purchaser wishes to return Goods to Alphac Limited for any of the above reasons, please contact us using the details on our Contact Page to make the appropriate arrangements.

2. MISUSE POLICY

When nitrous oxide is prepared and used by professionals for a medical emergency, it is done so in a safe and controlled environment. What is referred to as laughing gas and used in the medical profession is in actual fact not pure N20 nitrous oxide, which is what is contained within nitrous oxide cream chargers but is actually a mix of 70% oxygen and 30% nitrous oxide. 

We would like to remind all customers of the potentially fatal consequences of abusing laughing gas and the dangerous effects of nitrous oxide abuse. Any attempt at self-medication with laughing gas could lead to immediate death by asphyxiation or at the very least there could be serious long-term side effects. In order to combat this, we require that all customers purchasing our products will need to complete our online declaration and confirm they are aware of the issues and will make every effort to prevent our products from being misused. 

You must confirm that you are the named purchaser and at least 18 years of age and understand that you will be committing an offense if you provide false information to us. Also, we issue this warning that if we suspect you intend to misuse our products, we will refuse to sell any equipment to you. We will refuse to do any future business with you and your account (name, address, etc) will be blocked.

3. DELIVERY & PURCHASE RESTRICTIONS

We will not under any circumstances be shipping to the following places: 

Universities – University Halls of residence 
Colleges 
Schools 

We have a purchasing policy in place to stop any potential abuse. 

We retain our rights to enforce where we think there is a potential risk. 

4. ORDER LIMITS

The maximum amount of chargers (canisters) that can be purchased within a 24h 24-hour period is 50 cases. 
 
Any order that is more than 24 or multiple order attempts, can and will be canceled and refunded. 

What to do when electrical products purchased from us reach the end of their life. 
 
The EU has regulations that make sure retailers of electrical goods take some responsibility for the disposal of electrical products when they reach the end of their life. Below is an explanation of the WEEE Directive – basically it means that we will take back any products we have sold you and dispose of them for you. We urge you to either return WEEE waste to us – or make sure you take it to your local refuse cbcenterattery-poweredentre where they will know what to do with it. 

Used Batteries 
For all our battery-powered products we offer versions with a choice of rechargeable or disposable batteries. We are subsidizing the cost of the rechargeable batteries to encourage you to use them so please always buy this version even though it is slightly more expensive. The rechargeable batteries are a new type that doesn’t lose their charge over time – Low Self Discharge (LSD). We also sell a recharger. You can recharge these batteries 1,000 times – saving you money and your children from genetic deformities! 
We are happy to dispose of your batteries – but would recommend that you take them to your local recycling center. A lot of supermarkets have bins where you can dispose of them. Batteries contain materials which are very polluting – including lead which if you do not dispose of them properly ends up in the soil & water and then in the food you eat! So please take responsibility for your polluting waste! 

WEEE Regulations 
The Waste Electrical or Electronic Equipment (WEEE) Directive requires countries to maximize separate collection and environmentally friendly processing of these items. In the UK, distributors (including retailers) must provide a system that allows all customers buying new electrical equipment the opportunity to recycle their old items free of charge. Those establishing their own take-back scheme must as a minimum offer all customers buying new electrical equipment free take-back of their old electricals on a like-for-like basis. Unwanted electrical equipment is the UK’s fastest-growing type of waste. Many electrical items can be repaired or recycled, saving natural resources and the environment. If you do not recycle, electrical equipment will end up in landfill where hazardous substances will leak out and cause soil and water contamination harming wildlife and also human health. To remind you that old electrical equipment can be recycled, it is now marked with a crossed-out wheeled bin symbol. Please do not throw any electrical equipment (including those marked with the crossed-out wheeled bin symbol) in your bin.
